By accessing this website, you are agreeing to these Terms and Conditions, which include the Terms of Service for Classes and Facilities ("Terms of Service"), the Website Terms of Use ("Terms of Use"), the General Terms and Conditions, Copyright Policy, and our Privacy Policy. If you do not agree to these Terms and Conditions or our policies, then do not use this website, set-up an account, make a reservation, or take a class.

Terms of Service for Classes and Facilities

Push Cycle L.L.C., its subsidiaries, and affiliates ("we" or "us") provide indoor cycling classes. One indoor cycling class is called a "Single Class". A group or package of classes is called a "Package". These Terms of Service set forth the terms and conditions under which you can set up an account, make reservations, and pay for and participate in classes at Push Cycle. By setting up an account, making a reservation, or paying for or participating at Push Cycle, you agree to these Terms of Service.

Accounts

In order to purchase a class, make a reservation, take a class, or access certain features of the Push Cycle website, you must create an account. You may not use another person's account without their permission. When creating your account, you must provide accurate and complete information. You are solely responsible for all activity that occurs under your account, and you must keep your account password secure. Please notify Push Cycle immediately of any breach of security or unauthorized use of your account. Push Cycle is not liable for any losses you incur due to unauthorized use of your account.

Reserving and Paying for Your Cycle

To make a reservation at Push Cycle, you must first purchase a single class or a package (a bundle of multiple classes). You can reserve a bike up to two weeks in advance (Monday through the second following Monday), but no later than 5 minutes prior to the class start time. These reservation deadlines apply regardless of available website functionality.

For online purchases, Push Cycle accepts American Express, MasterCard, Visa, and Discover (though we reserve the right to change accepted forms of payment at our sole discretion). Your credit/debit card will be charged when you purchase a single class or package. All purchases are final and non-refundable. We will not process purchases made with incorrect, expired, or over-the-limit cards. Each class or package has an expiration date provided at the time of purchase. Unused class credits will not be refunded after the expiration date.

Class prices are subject to change at Push Cycle's sole discretion; however, any price increase will not affect classes or packages already purchased. If you fail to pay any charges when due, your services or privileges may be suspended or terminated. You are responsible for all fees, including attorney's fees and collection costs, incurred in Push Cycle's efforts to collect unpaid balances from you.

Cancellation Policy

To cancel a class, you must unreserve it at least 12 hours prior to the class start time. If canceled on time, the class credit will be returned to your Push Cycle account for future use (subject to the expiration date of your single class or package).

If you do not unreserve at least 12 hours in advance, or if you fail to attend a scheduled class without canceling, you will be charged a $10 late cancel or no-show fee. Additionally, your class credit will be forfeited. Fees are processed at the end of each month and are non-refundable.

You can cancel your reservation by:

  1. Logging into your Push Cycle account and clicking "unreserve" next to the class you wish to cancel.
  2. Calling Push Cycle at 832-785-7087 to cancel over the phone.

Arrival Policy

To ensure a safe and effective workout for all riders, Push Cycle encourages clients to arrive at least 10 minutes before class start time. If you arrive after class has started, you will not be permitted to join the class. In this case, you will forfeit your class credit and be charged a $5 late arrival fee. This policy is strictly enforced to avoid disrupting the experience of others and to maintain studio safety.

Health Representations

You represent and warrant to Push Cycle that you are in good physical condition and have no medical condition or impairment that could prevent you from safely participating in the classes, activities, programs, premises, facilities, and equipment provided by Push Cycle (collectively, "Classes and Facilities"). You acknowledge that Push Cycle has not given you any medical advice and cannot do so, including in relation to your physical condition or your ability to participate in the Classes and Facilities. You agree to consult your personal physician or another qualified health professional regarding any health or medical concerns prior to and during your participation in Push Cycle Classes and Facilities.

PLEASE NOTE: Individuals with chronic disabilities or conditions may be at increased risk when participating in Push Cycle's Classes and Facilities, and are strongly advised against doing so without medical clearance. Additionally, if in the opinion of Push Cycle staff you would be at physical risk by participating, you may be denied access to Classes and Facilities.

Waiver and Release

Without limiting any other waiver or release you have provided or may provide to Push Cycle, BY SIGNING UP FOR AND/OR ATTENDING CLASSES AND FACILITIES AT PUSH CYCLE, you acknowledge and agree that there are certain inherent risks and dangers associated with indoor cycling, exercise, and the use of related equipment.

IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN AND ACCESS THE CLASSES AND FACILITIES PROVIDED BY PUSH CYCLE, AND IN ADDITION TO ANY FEES PAID, YOU HEREBY:

  1. AGREE TO ASSUME FULL RESPONSIBILITY FOR ANY AND ALL INJURIES OR DAMAGE YOU MAY SUSTAIN OR AGGRAVATE IN CONNECTION WITH YOUR PARTICIPATION IN PUSH CYCLE'S CLASSES AND FACILITIES;
  2. WAIVE, RELEASE, AND FOREVER DISCHARGE PUSH CYCLE, ITS EMPLOYEES, OFFICERS, AGENTS, MEMBERS, MANAGERS, INVESTORS, AND REPRESENTATIVES FROM ANY AND ALL RESPONSIBILITY, CLAIMS, RIGHTS, CAUSES OF ACTION, OR LIABILITY FOR INJURIES OR DAMAGES TO YOUR PERSON OR PROPERTY ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN CLASSES AND USE OF FACILITIES;
  3. REPRESENT THAT YOU HAVE NO MEDICAL OR PHYSICAL CONDITION THAT WOULD PREVENT YOU FROM SAFELY PARTICIPATING IN PUSH CYCLE CLASSES AND FACILITIES OR THAT WOULD PUT YOU AT RISK, AND THAT YOU HAVE NOT BEEN ADVISED BY A PHYSICIAN NOT TO PARTICIPATE;
  4. AGREE TO EXECUTE AN ADDITIONAL "WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT" PRIOR TO ATTENDING YOUR FIRST INDOOR CYCLING CLASS AT PUSH CYCLE.

Term and Termination

Your rights to use the rides or classes included in any series or package purchased from Push Cycle remain effective through the expiration date of the series or package, unless terminated earlier. These Terms of Service will terminate immediately, without notice, upon the occurrence of any of the following:

  1. you elect to cancel your Push Cycle account;
  2. we post a new version of these Terms of Service and notify you (you agree that such notice may be given by any means, including by posting the new version on our website); or
  3. you breach these Terms of Service or engage in behavior deemed unacceptable by Push Cycle at our sole discretion (in which case you will not be entitled to a refund for any unused classes or rides).

If your account does not have any active classes or packages, Push Cycle reserves the right to terminate or suspend your account at any time, with or without notice. We may also terminate these Terms of Service and your account without notice and without liability if requested by government or law enforcement agencies.

If your account is terminated, you agree that Push Cycle may retain your information on file for a reasonable period to facilitate account reactivation, should you wish to return.

The sections titled "Waiver and Release," "Health Representations," and all General Terms and Conditions shall survive the expiration or termination of these Terms of Service.

Liability for Personal Property

Push Cycle is not liable for any personal property that is damaged, lost, or stolen while on or around our premises - including, but not limited to, vehicles, vehicle contents, or any property left in a locker. You will be responsible for any damage you cause to Push Cycle's facilities, equipment, furniture, or fixtures.

Changes to Classes and Facilities

Push Cycle reserves the right to add or eliminate studio locations, classes, and facilities available to clients. Operating hours are set by Push Cycle and may change at any time at our sole discretion. We are not obligated to maintain any specific programs, services, equipment, or amenities and may change, modify, or discontinue them as we see fit.

Rules and Regulations

You acknowledge the need for and agree to comply with all rules and regulations governing participation in Push Cycle's classes and use of our facilities. These rules may be communicated verbally, posted on our website, or displayed in-studio. Push Cycle reserves the right to modify, amend, or update any rules and policies at any time and at our sole discretion.
